Default Private party handgun sale ?

If I sell a handgun to a Texas resident who is out here for a few weeks is it legal? If so whats the right way to go about it? Thanks for any info.

No.

Out of state residents must use an FFL in their home state to recieve the firearm.

Again, for effect, NO NOT LEGAL.

You need to have it shipped to a FFL dealer in his home town. This is Federal Code.

Not really. Have him take a look at it and pay you here then ship it to his FFL. Shipping might be $20 and his dealer would charge him something for the transfer, around $20-$50 depending on the dealer. If he really wants the pistol it can be done legally for a couple extra bucks.

what if he drives to Vegas.....as in is here..in the flesh?


so you cant buy guns if you are in another state..there in person??

I was in a shop in Washington state a few years back looking at pistols and the dealer said he would ship it to my dealer in Vegas but I could not walk out with it there. Stupid laws right!

If you conduct a private party sale of a firearm with an individual you know to NOT be a resident of your state you are committing a felony.

The law as it stands does not require you to ask for ID before selling a gun, BUT you have stated publicly you know him to be a resident of another state.

If you complete this sale and are caught, I get dibs on the rest of your stuff. You won't need it in prison.
