Default Process of private party gun sale

Can someone help me I'm a bit confused about private party transaction...

If a NV resident owns a gun and wants to sell a gun to a non-NV resdient who happens to be visiting NV and physically in NV how does that work?

A Nevada resident can only sell a gun private party to another Nevada resident; otherwise the sale needs to go through an FFL. (so in your description, you must go through an FFL for a transfer.)

To further clarify, they can pay you for it while they are here visiting, but it would have to be shipped to an FFL in their home state and they can pick it up there.

^^^ Winning comment. Leave it up to your out of state buyer to find a FFL in his state that will accept a shipment from a private party.

DO NOT let him take the gun from you while he's visiting. I've confirmed with the ATF field office that it is a Federal crime in the past.

I guess I am a little punchy today...

So if an out of state thief robs my home and takes a gun they need a pawn shop with an FFL in their home state to complete the transfer?

For some reason I had the wacky idea that private party sales were just that... private. Learn something new every day I guess!

LOL!!! Yes of course! History has taught us that criminals follow gun laws, so a ban on shooting people with a gun would definitively end all gun deaths overnight...

We're actually fairly lucky in Nevada with private sales. Private parties in other states often have to involve a dealer/FFL regardless. We have it better up North versus Las Vegas when it comes to handguns, but otherwise that's the only difficulty about private partying a gun in Nevada.

I'm not sure it would be a violation of state law to sell the gun (I can't remember reading that anywhere), but Federal gun laws prohibit purchasing/taking ownership of a handgun outside of your own state, but does allow for a person to buy a rifle outside their home state if it comes from a licensed dealer/FFL

I've legally purchased new longguns in Utah (from Helmart in fact); it is a strange double standard that I can't buy a hand gun there without going through a Nevada FFL. But, on the bright side, I would be broke if I could!
